Welcome to cuteenglishteacher.ai. These Terms and Conditions ("Terms") govern your use of our website and AI-powered pronunciation coaching services operated by cuteenglishteacher LLC ("we," "us," or "our"), located in Southport, North Carolina.

By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before using our platform.

1. Description of Services

cuteenglishteacher.ai provides AI-powered English pronunciation coaching through a web-based platform. Our services include:

Real-time voice-based pronunciation coaching powered by artificial intelligence
Session-based coaching in 10, 20, and 30-minute increments
Phoneme-level feedback and pronunciation scoring
Session booking and scheduling
Student account and session history tracking

2. Eligibility

You must be at least 13 years of age to use our services. If you are under 18, you must have permission from a parent or legal guardian. By using our services, you represent that you meet these eligibility requirements.

3. Account Registration

To access certain features of our platform, you may create an account. You agree to:

Provide accurate and complete information when creating your account
Maintain the security of your password and account credentials
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activity that occurs under your account

4. Payment Terms

Our services are offered on a pay-per-session basis. By purchasing a session, you agree to the following:

Session packages: Starter (10 min / $5.00), Standard (20 min / $9.00), Extended (30 min / $12.00)
Payment processing: All payments are processed securely through Stripe. We do not store your payment card information.
Session activation: Your session timer activates upon confirmed payment. Sessions are non-transferable.
No refunds: Due to the digital and time-based nature of our services, all sales are final. Sessions that have been activated cannot be refunded.
Pricing changes: We reserve the right to change our pricing at any time. Price changes will not affect sessions already purchased.

5. Use of AI Technology

Our pronunciation coaching is powered by artificial intelligence, including large language models. You acknowledge and agree that:

AI coaching is not a substitute for professional human instruction in all circumstances
AI responses may occasionally contain errors or inaccuracies
Your voice input and text interactions may be processed by third-party AI providers to deliver coaching feedback
We do not guarantee specific learning outcomes or pronunciation improvements

6. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

Use our platform in any way that violates applicable laws or regulations
Attempt to reverse engineer, copy, or reproduce our AI coaching systems
Share your account credentials with others
Use automated tools, bots, or scripts to access our services
Submit harmful, offensive, or inappropriate content through our voice or text inputs
Attempt to circumvent payment requirements to access sessions

7. Privacy and Data

Your privacy is important to us. When you use our services:

Voice input is processed in real time to provide coaching feedback and is not permanently stored by us
Account information (email address) and session history are stored securely through Supabase
Payment information is handled exclusively by Stripe and is never stored on our servers
We do not sell your personal information to third parties

By using our services, you consent to the collection and use of your information as described above.

8. Live Session Conduct, Safety & Reporting

cuteenglishteacher LLC is committed to maintaining a safe environment for all students, including minors. The following provisions apply to all live, one-on-one, and group coaching sessions:

Eligibility verification. We rely in good faith on the age and identity information provided at registration and by parents/guardians. Any user who misrepresents their age or identity does so in violation of these Terms, and cuteenglishteacher LLC is not liable for such misrepresentation.
Parental involvement. For any student under 18, a parent or legal guardian may observe, join, or request to be present for any live session at any time, and is encouraged to do so.
Right to terminate. We reserve the right to immediately end any session, suspend, or permanently terminate any account, at our sole discretion, if a participant engages in conduct that is inappropriate, threatening, harassing, sexually suggestive, or otherwise unsafe. No refund will be issued to the party responsible for such conduct.
Session records. We may retain records of session dates, times, and written chat/text exchanges for safety, quality assurance, and dispute resolution purposes, consistent with our Privacy Policy.
Mandatory reporting. As an educator, cuteenglishteacher LLC complies with applicable mandatory reporting obligations under North Carolina and federal law. If we become aware of information suggesting a child is being abused, endangered, or exploited, we may be required to report this to the appropriate authorities.
Reporting a concern. If you or your child ever feel unsafe, uncomfortable, or experience inappropriate conduct during any interaction on this platform, please contact us immediately at jsmetana@cuteenglishteacher.com. All reports will be taken seriously and addressed promptly.

9. Intellectual Property

All content on cuteenglishteacher.ai, including but not limited to the coaching curriculum, feedback frameworks, website design, and branding, is the intellectual property of cuteenglishteacher LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Availability and Scheduling

Sessions are available Monday through Friday, 6:00 PM to 10:00 PM Eastern Time. We reserve the right to modify available hours, suspend services for maintenance, or cancel scheduled sessions with reasonable notice. In the event we cancel a confirmed session, we will provide a credit or refund at our discretion.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or that defects will be corrected. We make no guarantees regarding specific pronunciation improvements or learning outcomes.

12. Limitation of Liability

To the fullest extent permitted by law, cuteenglishteacher LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid for the session in question.

13. Indemnification

You agree to indemnify and hold harmless cuteenglishteacher LLC, its owner, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Brunswick County, North Carolina.

15. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the new Terms.

16. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our services will immediately cease.
